Terms of Service

These Terms of Service (“Terms”) govern your access to and use of neondotcreatives.com and the services provided by Neondot Creative Agency (“we,” “us,” “our”). By booking a call, purchasing a package, or otherwise engaging our services, you agree to these Terms.

1. Services Offered

We provide digital media and advertising services, delivered through the following packages:

  • Content Engine — social media management, short-form video content, and basic SEO.
  • Growth Pack — expanded social media management, additional video content, paid ad campaigns, and stronger SEO.
  • Authority Builder — full-service management including maximum video output, brand strategy, and brand promotion.

Full package details and pricing are listed on our website and may be updated from time to time.

2. Booking and Onboarding

Engagements typically begin with a free strategy call booked through our website or Calendly link. Once you select a package, we will confirm scope, timelines, and any information or assets required from you to begin work.

3. Payment Terms

All payments are processed through PAYONUS, our designated payment provider.

  • Package fees are billed monthly in advance unless otherwise agreed in writing.
  • Work begins only after successful payment confirmation.
  • You are responsible for providing accurate billing information and for any fees or charges applied by your bank or payment method.
  • Continued access to monthly services is contingent on payments being made on time.

4. No Refund Policy

ALL SALES ARE FINAL. WE DO NOT OFFER REFUNDS UNDER ANY CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO CHANGE OF MIND, DISSATISFACTION WITH RESULTS, EARLY CANCELLATION, OR NON-USE OF SERVICES ALREADY PAID FOR.

Given the custom, labor-intensive nature of content creation, advertising management, and strategy work, once a payment is made and work has commenced, that payment is non-refundable. This applies to one-time engagements and to each individual billing cycle of a monthly package. By making a payment, you acknowledge and accept this policy.

5. Client Responsibilities

To deliver services effectively, we require reasonable cooperation from you, including:

  • Providing brand assets, product information, and access to relevant accounts (e.g. social media, ad accounts) in a timely manner.
  • Reviewing and approving content or campaigns within agreed timeframes.
  • Ensuring any information, images, or materials you provide do not infringe on third-party rights.

Delays caused by lack of client input may affect delivery timelines and do not entitle you to a refund or fee reduction.

6. Intellectual Property

Upon full payment for a specific deliverable, ownership of that final deliverable (e.g. finished videos, graphics, ad copy) transfers to the client, except for any third-party assets, stock content, tools, or proprietary processes owned by us or our licensors, which remain our property or that of the respective owner.

Unless you request otherwise in writing, Neondot Creative Agency retains the right to showcase completed work in its portfolio, case studies, and marketing materials.

7. Cancellation and Termination

You may cancel an ongoing monthly package at any time by providing written notice to us. Cancellation takes effect at the end of the current paid billing cycle — no partial refund will be issued for the remainder of that cycle.

We reserve the right to suspend or terminate services if payment is not received, if you breach these Terms, or if we reasonably determine that continuing the engagement is not viable.

8. Limitation of Liability

Neondot Creative Agency provides marketing, content, and advertising services designed to support business growth, but we do not guarantee specific results, follower counts, revenue, or return on ad spend, as these depend on factors outside our control (including platform algorithms, market conditions, and third-party ad policies).

To the maximum extent permitted by law, our total liability for any claim arising from our services is limited to the amount you paid us for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

9. Confidentiality

Both parties agree to keep confidential any non-public business, financial, or strategic information shared during the course of the engagement, and to use it only for the purpose of delivering or receiving the agreed services.

10. Third-Party Platforms

Our services may involve the use of third-party platforms (e.g. Meta, Google, TikTok, PAYONUS, Calendly, WhatsApp). We are not responsible for outages, policy changes, or account actions taken by these third-party platforms.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Nigeria.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
